Die Änderungsanträge in 2. Lesung[1] haben vergangenen Dienstag keine absolute Mehrheit im Plenum des Europa Parlaments bekommen. </div><div class=""><br class=""></div><div class="">Damit haben wir jetzt ein sehr unklares und mehrdeutiges Gesetz zu diesem wichtigen Thema, welches als Verordnung noch dazu direkt in allen 28 Mitgliedsstaaten anwendbar ist. </div><div class=""><br class=""></div><div class=""><b class="">Trotzdem ist es noch nicht zu spät</b>. Telekom-Gesetzgebung wird ja durch Regulierungsbehörden exekutiert. Die können das Gesetz eher Provider- oder User-freundlich auslegen. Unsere Regulierungsbehörde RTR würde zum Beispiel mehr Netzneutralitätsverletzungen den Kampf ansagen[2] als das die britische Ofcom jemals tun würde. Stichwort: revolving door. </div><div class=""><br class=""></div><div class="">Dieser Spielraum ist aufgrund der Mehrdeutigkeit des Gesetzes erstaunlich groß. </div><div class="">zB </div><div class="">1) ob Netflix ein Spezialdienst sein kann, sich also eine "bezahlte Überholspur” kaufen kann </div><div class="">oder </div><div class="">2) ob das Zero-Rating von Spotify verboten werden kann</div><div class="">3) ob und welches klassenbasierte Netzwerkmanagement statt Best Effort möglich sein wird</div><div class="">ist offen. </div><div class="">Sichtbar ist dies auch in dem Kampf um die Deutungshoheit.[3] </div><div class=""><br class=""></div><div class="">Deshalb ist der nächste Schritt so essentiell. Die Europäischen Regulierungsbehörden (BEREC) haben 9 Monate Zeit Guidelines zu veröffentlichen, die genau diesen Interpretationsspielraum konkret auslegen. In diesem Prozess wird es eine Konsultation geben, in der sich <b class="">vor allem technisch versierte Leute</b>, aber auch jene die mit/im/um Internet Geld verdienen, politisch aktiv sind, nicht-kommerzielle Projekte haben, etc. einbringen sollten. </div><div class=""><br class=""></div><div class="">Zur Erinnerung, in den USA haben 4 Millionen Menschen sich bei der Konsultation der FCC beteiligt. </div><div class="">In Indien waren es über 1 Million bei der Konsultation von Airtel. </div><div class=""><br class=""></div><div class=""><br class=""></div><div class="">Wir werden auf <a href="http://savetheinternet.eu" class="">SaveTheInternet.eu</a> weiter über die Lage zu informieren und versuchen es so einfach wie möglich zu machen sich in die Entscheidungsprozesse einzubringen. </div><div class=""><br class=""></div><div class="">Hilfe ist nicht nur willkommen, sondern <b class="">überlebensnotwendig</b>.
